GENERAL TERMS AND CONDITIONS OF SALE
SUNDRIVE
1. Definitions and general concepts
These General Terms and Conditions are governed by Tunisian law and by the provisions of the Code of Obligations and Contracts relating to leasing.
The Lessor : la société SunDrive.
The Lessee : the driver(s) and payer(s) mentioned on the rental agreement and signatory/signatories thereto.
The Vehicle : the vehicle made available for the agreed-upon duration.
Damages : any damage sustained by the vehicle (bodywork, broken glass, light covers, mirrors, headlights, equipment).
Loss : theft, attempted theft, vandalism, fire, theft of accessories.
Territory : Tunisia. Any departure from the territory is strictly prohibited.
The contract is concluded intuitu personae and may not be assigned.
2. Requirements for renting a vehicle
The renter must provide :
Valid passport or ID card
Valid driver's license held for at least 24 months
Complete contact information
Valid credit card in the name of the primary driver
Age requirements
Minimum age : 28 years old (may vary depending on the category)
Important: The same credit card used for the booking must be presented when the vehicle is handed over.
Electron, Maestro, or similar cards are not accepted.

3. Bookings, cancellations, and modifications
Cancellation
Free cancellation up to 72 hours before departure (excluding July & August)
Juillet & août : réservations non remboursables
Modification
Free up to 72 hours before departure (excluding July & August)
Fees may apply during the high season
4. Start, duration, and end of the rental
4.1 Start
The rental begins on the date and time the vehicle is made available, as indicated in the contract.
Tout véhicule immobilisé du fait d’une réservation confirmée est dû.
4.2 Duration
The rental is calculated in non-divisible 24-hour periods.
1-hour grace period for late returns
Beyond that: 1 additional day charged
No refund in case of early return
Toute prolongation doit être demandée 48h à l’avance et reste soumise à l’accord de SunDrive.
4.3 End of rental
The rental ends only after :
Return of the vehicle
Return of the keys and documents.
Inspection par un agent SunDrive
The renter remains responsible for the vehicle until this effective return.
SunDrive n’est pas responsable des objets oubliés dans le véhicule.
5. Condition and use of the vehicle
État du véhicule
Un état descriptif est établi au départ et au retour.
Tout dommage non signalé au départ est réputé imputable au locataire.
Utilisation
Le véhicule :
Doit circuler uniquement en Tunisie
Ne peut être conduit que par les conducteurs autorisés
Doit être utilisé en bon père de famille
Il est interdit notamment de :
Sous-louer ou céder le véhicule
Transporter des passagers ou marchandises contre rémunération
Participer à des compétitions ou essais
Circuler hors routes carrossables
Conduire sous alcool, drogue ou substances altérant la conduite
Utiliser le véhicule à des fins illicites
Toute infraction est à la charge du locataire.
6.Mileage – Fuel
Mileage limited to 300 km/day 200 millimes per additional kilometer
The vehicle is provided with a specified fuel level and must be returned with the same level.
Pricing – Payment – Security Deposit
Price
The price includes:
Vehicle rental provision
Mileage is limited to 300 km per day.
Does not include :
Fuel
Fines
Damages :
Optional services
Payment
The estimated amount must be paid in advance.
Any remaining balance or additional charges may be charged to the presented credit card.
Security deposit
A security deposit is required upon vehicle pickup.
It is used to cover:
Damages :
Loss or theft
Delays
Fines and miscellaneous charges
If no charges apply, the security deposit will be refunded at the end of the rental period (subject to bank processing times).
Liability – Accident – Damage – Loss
The renter is responsible for the vehicle while it is in their custody.
In case of an accident or damage :
Complete an accident report form.

Ne jamais engager de réparation sans accord
If the renter is held responsible,
repair costs will be charged to the driver, based on the damage assessment.
A replacement vehicle may be offered subject to availability, without contractual obligation.
In case of loss or theft:
Immediate reporting to the authorities.

Return of the keys and documents.
Failure to return the keys results in the renter assuming full responsibility.
Fines and Violations
The renter is responsible for:
- All fines.
- Traffic violations.
- Traffic code violations.
- SunDrive pourra avancer le paiement et se retourner contre le locataire.
Liability Waiver
Failure to comply with these Terms and Conditions may result in:
Full responsibility of the renter
Full billing of all damages
Immediate termination of the contract
Applicable Law – Claims
These Terms and Conditions are governed by Tunisian law. au droit tunisien.
Any claim falls under the exclusive jurisdiction of the Tunisian courts. des tribunaux tunisiens.
Data Protection
The collected data is necessary for rental management.
